What you need to know:

  • Effective January 1, 2011, NASDAQ OMX® will assess fees to firms that offer controlled Hosted Solutions.
  • NASDAQ OMX will update its policy whereby providers of controlled Hosted Solutions containing NASDAQ OMX data must report and pay for the number of Hosted Solutions customers.
  • For NASDAQ OMX U.S. Market Data, NASDAQ OMX will not assess separate fees related to Hosted Solutions Product distribution prior to January 1, 2011.

What is a Hosted Solution?

A Hosted Solution is a delivery option for a controlled data product that contains NASDAQ OMX information offered by a distributor on behalf of a client organization, where the distributor can substantially control the information for the purpose of reporting usage or qualification. Controlled data products include systems where the Distributor monitors and controls the entitlement and access to the market data.

Rather than creating their own systems and displays, the client organization contracts with the distributor to create and administer a website or other system on its behalf. When the distributor allows a client organization - that is not receiving uncontrolled access to the data - to label, brand, or benefit from the distributor’s distribution of information to the external subscribers of the client organization, NASDAQ OMX deems this to be a Hosted Solution. Please contact NASDAQ OMX if your firm would like a determination of whether a particular product is considered a Hosted Solution.

Why is NASDAQ OMX implementing this fee?

NASDAQ OMX recently completed a comprehensive review of the market data product suite. Most recently, NASDAQ OMX specifically reviewed the pricing for Hosted Solutions products. In an effort to harmonize the fee structures globally, NASDAQ OMX is now introducing a global solution for a subset of data products.

NASDAQ OMX will continue to strive toward providing the full range of product choices demanded by our global customer base. Feedback is extremely valuable and will always be carefully considered when reviewing future initiatives.
